Clarity offers an exclusive remote service for overseas clients who are unable to travel to Dubai to complete the transfer These can be as broad or narrow in scope. Gifting in Dubai is a practice whereby a person can transfer part or all of a property to an eligible relative as a gift, entitling them to a reduction in the transfer costs of the property. Our conveyancers are here to help when an owner wishes to transfer their property of part shares to their spouse or when parents want to gift a property / part shares to their children, or vice versa. Currently, in these types of transfers, the Dubai Land Department charges 0.125% of the valuation amount as a transfer fee as opposed to 4%. Conveyancing is an important part of the sale/purchase of a property. It involves the legal transfer of a property from one owner to another. We know that buying a property is not always easy and it can be quite daunting for a 1st time buyer. There are always timelines and consuming tasks to complete within certain timeframes. Failure may threaten the property transfer. As conveyancers we deal with all parties to co-ordinate the sales progression, keeping everyone informed, making sure all requirements are met. Given the complex nature of property transactions, it is highly recommended that you engage the services of a conveyancer for this process.

Property transfers can be a complex process, so there are lots of reasons to hire a conveyancing service. These include: 1. Preparing, clarifying and reviewing all legal documents. 2. Calculating the various fees & reimbursements in relation to a property purchase or sale. 3. Dealing with your bank or financial institution if a mortgage is involved. 4. Securing an NOC to transfer a property from the management company or developer, if necessary. 5. Using a Power of Attorney to represent your interest in front of government institutions. 6. Ensuring you safely receive the proceeds of a sale including any reimbursements for service charges and or rent. 7. Ensuring a smooth transfer and solving any issues that may arise. 8. Providing step-by-step guidance to you at every stage of the buying/selling process.

The length of the conveyancing process will depend on various factors. For example, if the Buyer or Seller has a mortgage, if there are any overseas documents which must be attested, or if there are any complex company documents required as part of the transaction. Typical timescales for the conveyancing process range from 1-12 weeks. Ensure you use a reputable conveyancing service, like Clarity, to make the process as quick and efficient as possible.

Power of Attorney is a document that allows us to act on your behalf and in your best interests to protect you and your property. ​Whether you (Seller or a Buyer) do or do not have time to come to Dubai for the various processes in your property transaction, designating one of our Clarity staff as your Power of Attorney ensures that every process during your transfer is handled timely and efficiently, with extensive expertise. We can arrange a POA remotely within 2 days without you having to step outside your front door.

Gifting process is only allowed between first degree kin i.e. between husband and wife; to sons and daughters or to mother and father. Gifting does not apply between siblings or uncles/ aunts. These are considered as a sale and therefore 4% payment will be required by the Dubai Land Department. Gifting fees are 0.125% of the Land Department's valuation amount.
